FOUR65 – Terms & Conditions

1. TERMINOLOGY

Studio refers to the ground floor of FOUR65 available for hire at 4/65 Centennial Circuit Byron Bay NSW.
Equipment refers to any equipment and its accessories included in the Booking. All Equipment is supplied by Lume Supply, and separate terms and conditions apply, which will be provided upon hiring FOUR65 if required.
In House Services refers to the services that FOUR65 offers in addition to Studio Hire.
Us and or We refers to FOUR65 and the team that operates FOUR65.
Lume Supply refers to the Equipment and prop hire company that supplies FOUR65 with rental equipment and props.
You and Your refers to the person, brand or business attached to the booking.
Hire Fee or Rates refers to the estimated price or fee that will be charged to hire the Studio, for In House Services or Equipment at FOUR65.
Booking refers to the Studio hire and or Equipment hire as per your request confirmed via email and your paid invoice.
Booking Time refers to the amount of time in hours you have booked the Studio and Equipment.
Additional Fees refers to but is not limited to:

Overtime or early entry fees;
Excessive use of consumables;
Additional cleaning or repair fees;
Equipment hired through Lume Supply;
Weekend surcharge.

2. TERMS OF ENGAGEMENT

(a) These terms and conditions (Terms) form the agreement under which You engage in hiring the Studio from FOUR65 and, if applicable, Equipment from Lume Supply. Bookings may be placed via email, or online.
(b) Any bookings made by you or your agent is considered authorised to bind you to these Terms and Conditions.
(c) You accept these Terms and Conditions when one, all or a combination of the following occurs:

An invoice is paid;

You reply and confirm to any correspondence;

Arriving at FOUR65 and proceeding with your booking.
(d) You warrant that You have received and reviewed these Terms and agree to be bound by them.
(e) These Terms are governed by the laws of New South Wales, Australia.
(f) These Terms can only be varied in writing, signed by authorised representatives of both parties.

3. SECURITY

(a) You must provide valid photo ID and credit card as security.
(b) We may charge your credit card for any Additional Fees or damage.
(c) By providing your credit card You authorise us to recover any unpaid charges via your credit card.
(d) By providing your credit card details, you expressly authorise us to charge for any Additional Fees, including but not limited to: early entry, overtime, after-hours access, damage repair, and excessive cleaning.

4. FEE

Quotes or invoices list the rates or hire fee confirmed with you. Any changes will incur Additional Fees.
(c) Quotes are valid for 10 days from the Order date.
(d) Early Entry and Overtime are charged separately, as outlined in Section 10.

5. PAYMENTS AND INVOICING

(a) All invoices are due on receipt and are to be paid in full.
(b) Payment must be received before the Hire Period begins unless otherwise agreed.
(c) New customers must provide a valid credit card in form of security for unpaid invoices, Additional Fees or damages.
(d) Additional Fees will be invoiced at the conclusion of your booking and are to be paid either via credit card or bank transfer within 7 days.

5A. IN HOUSE SERVICES

(a) All In House Services must be paid for in full prior to the commencement of the Hire Period.
(b) Cancellations of In House Services are subject to the same cancellation policy and fees as outlined in Section 13 (Cancellation or Date Change).
(c) If payment for In House Services is not received prior to the Hire Period, we reserve the right to withhold or cancel the provision of those services without liability.

6. INSURANCE

FOUR65 is covered by Public Liability.
Our insurance excludes:

Intentional damage;
Negligence;
Electrical damage;
Damage by animals;
Theft from unsecured spaces;
Improper use.
Coverage is subject to our insurer’s policy.

7. PROPERTY AND EQUIPMENT

(a) All Equipment remains the property of Lume Supply. The Studio and Booking inclusions is property of FOUR65.
(b) Risk passes to You upon commencement of your Booking.
(c) You may not encumber the Equipment.
(d) Studio and Equipment must be left in original condition, less fair wear and tear.
(e) All Equipment and its accessories must stay onsite and be present at the conclusion of your Booking.

8. USE OF EQUIPMENT AND STUDIO

(a) FOUR65 is not responsible for Your personal items.
(b) All personal items must be removed at end of hire. Addition Fees may apply in the form of overtime fees for any personal items or equipment still onsite at FOUR65 at the conclusion of your booking.
(c) Booking Time includes bump-in and bump-out. Late exit fees apply.

8A. STUDIO ACCESS AND RESTRICTIONS

(a) Access to the Studio outside of staffed hours is by the key located in the lock box. The lock box code will be provided to You for the Hire Period only.
(b) The lock box code must not be shared with any third parties. Any unauthorised disclosure or use of the code will be treated as a breach of these Terms.
(c) Access to the upstairs office is strictly prohibited unless prior written consent is obtained from Us.
(d) A replacement key fee of AUD $80.00 will be charged if the Studio key is not returned to the lock box or otherwise returned at the conclusion of the Hire Period.
(e) You remain responsible for ensuring the Studio is locked and secured upon departure during or after the Hire Period.

9. LIABILITY

(a) You are liable for loss or damage to Equipment or Studio. You must notify us of issues and assist with recovery or repair. You indemnify FOUR65 and Lume Supply.
(b) We are not liable for specifications not met, site-related damages, or indirect losses. Our liability is limited to repair/replacement or manufacturer warranty.

10. BOOKING TIMES, EARLY ENTRY, OVERTIME & AFTER-HOURS FEES

(a) Booking Times
Your booking begins and ends at the times confirmed in your reservation.
Booking times include bump-in (setup) and bump-out (pack down). Please plan accordingly.
(b) Early Entry
Entry before the scheduled booking time is subject to availability and must be approved in writing.
Early entry is charged at $110 per hour, billed in 30-minute increments.
(c) Standard Overtime
Time used beyond your scheduled end time will be charged at $110 per hour, billed in 30-minute increments.
Overtime begins the moment your booking time ends and will be applied to bump-out delays, lingering setup, or continued use of the space or equipment.
(d) After-Hours Access
Access beyond 5:00PM must be arranged in advance and is subject to an additional after-hours surcharge of $60 per hour.
Unapproved after-hours usage will incur the standard overtime rate plus the after-hours surcharge.
(e) Unattended Property
Any personal or professional items left onsite past your scheduled time will trigger overtime charges until removal is complete.

11. DAMAGE FEES

By confirming your booking, you agree to be responsible for all damages incurred during your hire period. This includes, but is not limited to:

Broken or damaged windows, doors, or fixtures;
Damage to equipment or accessories (including from improper use);
Damage to furniture, props, or decor;
Scratches, scuffs, stains, or holes in the walls or floors (outside of reasonable wear).

(a) Damage Charges
All damages will be assessed post-booking.
Repair or replacement fees will be charged to the card on file.
If damages exceed the card limit or are not paid within 7 days, we reserve the right to take further legal action and charge any recovery costs.

12. OH&S

Both parties must comply with all health and safety regulations.

13. CANCELLATION OR DATE CHANGE

Bookings may be cancelled in writing.
Date changes are possible any time up until the date of your booking but may incur a $75.00 admin fee.
Date changes are subject to availability.

Cancellation fees:

Full (100%) refund if cancelled up to 5 Business Days prior to booking;
75% refund if cancelled up to 3 Business Days prior to booking;
50% refund if cancelled up to 2 Business Days prior to booking;
0% refund up to 1 Business Day or on day of booking.

14. TERM AND TERMINATION

We may terminate if You breach Terms, become insolvent, or fail to pay. On termination, all outstanding fees are due. FOUR65 may recover Equipment and enter premises if necessary. You appoint us as attorney to enforce these Terms.
